How much is my workers compensation claim worth?

Your workers’ compensation payments are based on what you earned while working before you experienced the workplace injury or occupational disease. This will be different for each person, so your wisest course of action is to seek a free consultation from a Pennsylvania workers’ compensation attorney. An attorney will be able to answer your questions and review the factors that will affect the value of your workers’ compensation claim.

How does a light-duty job affect compensation payments?

The answer to this question will depend on whether you make the same amount of money, more money, or less money than you did prior to the workplace injury. If you make the same amount or more, your lost wages payments will be suspended. If you make less, then you will receive partial disability benefits for lost wages. This will equate to about 2/3 of the difference between your former and current wages. For example, if you used to make $500 per week, but make $300 per week on light duty, then you will receive 2/3 of the difference between the two. The difference here is $200, so you would receive somewhere around $130 to $135 in partial disability payments. Having said that, there is a maximum weekly payment rate that is set each year. Injuries that occurred in 2014 have a maximum weekly payment of $932 in Pennsylvania.
